Your privacy is important to us, we are committed to protecting it and we understand that you want to keep your information private. This Privacy Policy is designed to help you decide whether to use the Site and its Contents and in what manner, and it describes how we collect, store and use information on individuals who use the Site or that form part of its Contents. This Privacy Policy forms part of the Terms of Use, terms not defined herein shall have the meanings ascribed to them in the Terms of Use.

We process your personal data as Controllers under the Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights, which is the country’s adaptation of the European General Data Protection Regulation (GDPR). This means that we are responsible for how we process and protect your data, and we take it very seriously.

This Policy is a legally binding agreement between you (“you” or “user”) and us. By visiting, accessing or using the Site and its Contents, or providing information to us in any other format, you agree to and accept the terms of this Privacy Policy, as written in its last version, and you consent to the collection and use of information in the manner set out in this Policy. We encourage you to review this Policy carefully and to periodically refer to it so that you understand it and its subsequent changes if any. If you do not agree to the terms of this privacy policy, please stop using the Site immediately.

This Privacy Policy applies only to the Site and its Contents. The Policy does not apply to third party websites, linked to our Site. Third party websites or services may have their own privacy policies and we advise you to read them carefully.

What information do we collect and how do we use it?

Site functionality

If you choose to provide us with your Personal Information on the Site, we may transfer that Personal Information within Impactyield or to Impactyield’s third-party service providers, but only to provide services on the Site, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world.

We collect the following information:

a) User information. Information provided to us through the forms existing in the Site:

i) Contact Us: full name, email address, company, phone number (optional).
ii) Add a Fund: full name, email address, company, phone number (optional).
We use that information to provide you with the service or answer the questions that initiated the interaction. We also keep that information for later interactions including but not limited to Site update announcements and direct marketing.

b)Personal information that forms part of the Contents. Information about professionals related to the impact investing community (in particular fund managers, asset managers directors, etc). We collect, only after explicit permission and most of the time through direct interaction, the following information: name, picture, linkedin profile (or other public biographic reference), professional email, professional phone, twitter handle.

We treat that information following the same guidelines that we use for user’s personal information and we do not publish it without explicit permission. After that explicit permission, although we strive to technically protect any improper use, Impactyield is no longer responsible for the use that any Site user or third party can make with that data.

We use that information only as part of the Site Contents to provide accurate fund information to the users.

Third parties & Advertisements

We do not sell Personal Information to third parties. We do allow third party service providers to collect Personal Information through our Site and share Personal Information with third party service providers for the business purposes described in this Privacy Policy, including without limitation advertising and marketing on our Site based on users’ online activities over time and across different services and devices.

We may use a third-party advertising technology to serve advertisements when you access the Site. This technology uses your information with regards to your use of the Site to serve advertisements to you (e.g., by placing third-party cookies on your web browser).

Research & Insights

We may also share aggregated information (information about our users that we combine so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, research, demographic profiling, marketing and advertising, and other business purposes.

Direct Marketing

We may share your full name, email address and phone number with certain asset managers(s) (the “Asset Manager”) or investors (the “Investor”) in the event that you have granted permission to receive promotional materials from any of the two at the time of contact with us. The Asset Manager may periodically use your full name, email address and phone number for the purpose of providing you with promotional materials if your permission was granted at the time of contact and you have not stated the contrary at a later time in accordance with the provisions hereof. At any time, you may request to discontinue receiving these offers or Impactyield.com’s marketing emails by clicking on the unsubscribe link in the email’s footer. If you unsubscribe we will remove your full name, email address and phone number from our marketing distribution lists and from any future lists we may share with the Asset Manager or the Investor. However, you may need to also separately unsubscribe from marketing offers sent by the Asset Manager or the Investor themselves. Please note that in order to send you promotional materials, the Asset Manager or the Investor may assign you credentials for your site through an account. You may contact them at any time to remove the account.

How do we manage the information?

We will retain your personal information for the duration required to provide our Services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing personal data, communications and anything else as required by applicable laws and regulations.

Security and Confidentiality

The Company treats your Personal Information in strict confidentiality, and the server in which this data is to be stored includes the necessary industry-standard security measures to prevent accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access. However, we cannot completely guarantee the security of your information, which might be accessed, disclosed, modified, or destroyed, and it should be emphasized that you share this information at your own risk.

Assignment
